Terms of Service

1. Agreement

These Terms of Service ("Terms") are an agreement between you and Keep ("Keep", "we", "us"), the operator of keep-posting.com and the Keep email relay (the "Relay"). By creating an account or using the Service you agree to these Terms and to the Privacy Policy. If you do not agree, do not use the Service.

3. The Relay

  1. Your Ship holds your posts and your List. When you choose to email a post, your Ship submits it to the Relay, and the Relay delivers it to your Confirmed Readers from your Keep subdomain under the name you publish under.
  2. Keep is the sender of record for every message the Relay transmits and is accountable for it to mailbox providers and under applicable law. Sections 4 through 8 are the conditions of access to the Relay.
  3. The Relay sends only to Confirmed Readers. Addresses on your List without a Consent Record are not emailed.
  4. Keep intends to offer a way to connect your Ship to an email provider of your own choosing in place of the Relay. Mail sent through your own provider is governed by your agreement with that provider, not by Sections 4 through 8.

4. Consent and List Sources

  1. An address becomes a Confirmed Reader only by (a) submitting your subscribe form and clicking the confirmation link Keep sends, or (b) being included in an import under Section 5 and clicking the re-confirmation link Keep sends.
  2. You may not add addresses to the Relay by any other means.
  3. You may not use purchased, rented, scraped, harvested, traded, or shared lists.
  4. Lists are never shared, merged, or made visible between writers.

5. Imports

  1. You may import subscribers only from a publication you control, after verifying ownership by the method Keep provides, and only in that platform's native export format.
  2. Each eligible imported address receives one re-confirmation email from Keep. Addresses that do not confirm within 14 days are not emailed again.
  3. Keep may pause or reject an import whose messages bounce at an elevated rate.

6. Prohibited Content and Conduct

You may not use the Relay to send:

  1. unsolicited or bulk commercial email;
  2. email with false or misleading headers, sender names, or subject lines;
  3. content that is unlawful, or that infringes the rights of others;
  4. content that violates the AWS Acceptable Use Policy;
  5. anything to a list obtained in violation of Section 4.

7. Identity

  1. You may publish under any name, including a pen name.
  2. You may not impersonate any person or organization, or misrepresent the origin of what you send.
  3. Replies from Readers are delivered to the email address associated with your account.

8. Unsubscribes, Limits, and Suspension

  1. Every message sent through the Relay includes an unsubscribe link and one-click unsubscribe headers. An unsubscribe takes effect immediately and permanently, without login or confirmation. A Reader who unsubscribes can rejoin only by subscribing again themselves.
  2. Relay sending is subject to daily volume limits, which increase with a clean sending record.
  3. Keep automatically suspends Relay access for a writer whose bounce or complaint rates exceed the thresholds in Keep's sending policy.
  4. Keep may suspend or revoke Relay access immediately for any violation of these Terms. Repeat or serious violations result in removal from the Relay.
  5. Suspension affects only sending through the Relay. Your Ship, your posts, and your List are unaffected.

9. Your Content and Data

  1. You retain all rights to your posts. You grant Keep only the license necessary to host and deliver them as you direct.
  2. You are the controller of your List. Keep processes it on your behalf as described in the Privacy Policy and holds Consent Records for the Readers who confirmed.
  3. You may export your posts, your List, and your Consent Records at any time.

10. Accounts and Eligibility

  1. During launch, accounts are created by invitation.
  2. You are responsible for maintaining access to the email address associated with your account and for activity on your Ship.
  3. You must be at least 18 years old to use the Service.

11. Termination

  1. You may close your account at any time.
  2. Keep may suspend or terminate accounts that violate these Terms. Where practicable, Keep will give notice and an opportunity to export your data.
  3. Sections 9, 12, 13, and 14 survive termination.

12. Disclaimers

The Service is provided "as is" and "as available". Keep makes no warranty that the Service will be uninterrupted, error-free, or that any message will be delivered, and disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the extent permitted by law.

13. Limitation of Liability

To the extent permitted by law, Keep will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from or related to the Service. Keep's total liability for any claim arising from the Service will not exceed the greater of the amount you paid Keep in the twelve months before the claim or one hundred US dollars.

14. Indemnity

You will defend and indemnify Keep against claims arising from content you send through the Relay, from your List, or from your breach of these Terms.

15. Changes

Keep may revise these Terms. Material changes will be announced by email to the address on your account at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

16. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Delaware.
